Terms of Service

Effective June 2026. Operator: Folsom Holdings, LLC, a Maine limited liability company, the wholly-owning entity of santacalls.live ("Santa Calls," "we," "us," or "our").

Prelaunch notice: Santa Calls is not accepting payments or placing customer calls yet. Calls are planned to open in December 2026. Payment and paid-service terms below take effect when checkout opens.

These Terms govern your access to and use of the Santa Calls website and service. By creating an account or purchasing a plan, you agree to these Terms.

1. The service

Santa Calls is a service that delivers a live, AI-generated phone call from a Santa character to a phone number you have verified. You choose the scenario and personalization details (child's name, age band, family touches), schedule the call for "right now" or a future time, and we dial your verified phone at that time. Calls are not recorded by default.

2. Eligibility

  • You must be at least 18 years old.
  • You must be the parent or legal guardian of any child whose name or details you enter, or otherwise have authority to use that information for the call.
  • You must own or have explicit permission to call the phone number you verify.
  • You must not be barred from using the service under applicable law.

3. Your account

  • Sign-in is via a magic link sent to the email address you provide. Keep your email secure; anyone with access to your inbox can sign in as you.
  • You may only have one account per email address. Sharing an account is discouraged but not strictly prohibited.
  • You are responsible for all activity on your account.

4. Plans, pricing, and billing

  • Plans are sold as one-time purchases (single call, multi-call packs, gift packs, and season pass). Current pricing is listed on the pricing page and may be updated from time to time; the price you see at checkout is the price you pay.
  • Payments are processed by Stripe. By purchasing, you authorize the listed charge and agree to Stripe's own terms governing the payment transaction.
  • Plans do not auto-renew. A season pass is a fixed-term plan that expires on its stated end date.
  • Unused credits on a non-season plan remain valid for 12 months from purchase unless otherwise stated at checkout.

5. Refunds

See our Refund Policy for full terms. In summary: if Santa fails to successfully dial your verified phone, the credit is automatically refunded to your plan. Unused single calls and packs may be refunded for any reason within 24 hours of purchase by contacting info@santacalls.live.

6. Acceptable use

You agree not to:

  • Use the service to call a phone number you do not own and do not have explicit permission to call.
  • Use the service to harass, intimidate, or distress any recipient.
  • Impersonate any real person other than the public Santa Claus character the service is designed to portray.
  • Attempt to extract the underlying voice model, scenario prompts, or other proprietary content for resale or republication.
  • Use the service to send marketing or commercial content of any kind to the recipient.
  • Attempt to disable or interfere with the service's security, rate-limiting, or other technical controls.

7. Calls, recording, and consent

  • Calls are not recorded by default. We may briefly retain diagnostic transcripts to investigate problems and then delete them.
  • Some U.S. states require all-party consent to record a phone call. We do not record, but you are responsible for any recording you may choose to make on your own device.
  • For gift calls, the recipient must affirmatively accept the gift (by responding to a code or link) before any call is placed to their phone.

8. Intellectual property

The Santa Calls name, the santacalls.live website, the scenario library, the brand assets, the voice models we license and configure, and all underlying source code are the property of Folsom Holdings, LLC or its licensors. You receive a limited, non-exclusive, non-transferable license to use the service for personal, non-commercial purposes for the duration of your account.

9. Third-party services

The service relies on third parties including Cloudflare, Twilio, xAI, Resend, and Stripe (the "Sub-processors"). Their availability, performance, and policies are outside our control. We are not liable for outages or behavior of these providers, though we will work in good faith to resolve issues that affect you.

10. Disclaimers

The service is provided "as is" and "as available." We do not warrant that calls will always connect, that the voice will always be perfectly natural, that every conversation will go to plan, or that the service will be uninterrupted. Santa Calls is for entertainment and family enjoyment; it is not a substitute for professional advice of any kind.

11. Limitation of liability

To the maximum extent permitted by law, Folsom Holdings, LLC's total liability to you for any claim arising from your use of the service is limited to the amount you paid for the specific plan that gave rise to the claim, or $50, whichever is greater. We are not liable for indirect, incidental, consequential, special, or punitive damages.

12. Indemnification

You agree to indemnify and hold Folsom Holdings, LLC harmless from any claim brought by a third party arising from your breach of these Terms or your misuse of the service, including any call you arrange to a phone number you did not have permission to call.

13. Termination

You may close your account at any time via the dashboard or by emailing info@santacalls.live. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used to abuse or harm a recipient.

14. Governing law and disputes

These Terms are governed by the laws of the State of Maine, without regard to its conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in York County, Maine, and you consent to personal jurisdiction there.

15. Changes

We may update these Terms from time to time. Material changes will be posted here with a new effective date and notified to active account holders by email. Continued use of the service after a change constitutes acceptance.
